What Is Medical Malpractice?

Medical malpractice or negligence occurs when a doctor, surgeon, nurse, hospital, or other medical professional performs their job in a way that deviates from the accepted medical standard of care. The standard is “what would a reasonable health care provider (physician, nurse, etc.) do under the same or similar circumstances?”  In other words, physicians have a duty to their patients to provide medical care that is reasonable and complies with the standards in their area of specialty and practice nationwide.  Just like drivers have a duty to drive safely and not cause harm to other drivers, doctors, nurses, and hospitals have a duty to their patients to treat them according to accepted medical standards of care and to avoid causing any undue harm.  When a doctor or other medical professional breaches this duty, they are negligent in legal terms.

Proving Medical Malpractice

In practice, however, determining medical standards of care is a complex process.  Medicine is not an exact science and, in practice, often human judgment and emergencies result in situations where there is no exact action required by medical standards. This is one reason why medical malpractice cases are so difficult for attorneys to successfully prosecute.  However, it is assumed that, for any situation, all medical professionals should react in more or less the same way, given their level of education and training.  Obviously, no one person can possibly know how to treat every illness and injury, which is why there are so many sub-specialties in medicine and such extensive documentation of medical knowledge.  Thus, if a physician or health care provider encounters a patient for whom he or she does not know the proper treatment, he or she is required to obtain the knowledge necessary, or better yet, to obtain a opinion from a more qualified doctor.

Ignorance is no defense to medical negligence.  In fact, the law is meant to protect patients from medical malpractice.
