Under Oklahoma law only certain individuals can file a wrongful deathclaim. The statutes specify who those people are and prioitze who can bring the claim. The first person whose netitled to bring the claim is the personal representative of the estate. If there is no personal rep that has been appointed then the surviving spouse may bring the claim. If there is neither a surviving spouse nor a personal representative that has been appointed, then the children may bring the claim. If there are no children, no personal representative and no spouse surviving spouse, then the next of kin may bring the claim.
