Under Oklahoma Law, the statute of limitations for a wrongful death claim is two years from the date of death. What that means is that you must file a wrongful death claim within two years of the date of death, or it is forever barred. No matter how valid the claim is, if you wait until after two years, you cannot bring the claim. So it is very important that if you think you have a wrongful death claim, that you consult with an attorney as soon as possible. Because you don’t want to wait until right before the statute of limitations expires because the attorney has to gather evidence to determine whether there is a valid claim or not.
