Not every birth injury is a result of medical malpractice. However, if your child has suffered certain kinds of birth injuries, it very well may have been the result of medical error or nursing error. These injuries include cerebral palsy and Brachial Plexus Injury. Cerebral palsy is a condition that is a result of an injury that occurs to the baby during labor and delivery. It is often a result of a lack of oxygen to the brain during the delivery process. Cerebral palsy is a catastrophic medical condition that leaves a child with lifelong physical and mental disabilities and often requires millions of dollars in future medical expenses. Another type of birth injury that may be a result of medical malpractice is what is called Brachial Plexus Injury, or BPI. BPI is a severe injury to a child’s nerves, muscles and bones in their shoulder that results from their shoulder becoming stuck in the birthing canal during labor and delivery. Children who suffer severe BPI are also subject to lifelong medical care and permanent disability to their arm and shoulder.
