Standing With You

While traveling down the highway, it is not uncommon to see debris and garbage scattered along the roadside. Usually, this mess poses little to no danger to drivers and is nothing more than an eyesore. However, occasionally we come across items in our lane that we have to swerve to avoid, and for one Oklahoma woman doing so caused her vehicle to lose control.

During a Monday morning commute, an SUV heading east on a Tulsa highway came across debris in the road which caused the driver to swerve. The driver, an unidentified woman then lost control of her SUV which caused it to overturn on the roadway. When authorities arrived at the scene the woman was alive but complaining of back pain. She was then transported to a local hospital for care.

The Sheriff’s department and Tulsa firefighters were dispatched to the scene and had to close the highway down to clear the wreckage. Although it is not known what the nature of the debris was that caused the driver to swerve, there could be a question of who was responsible for removing it.

While the issue of negligence almost always comes to mind when assigning fault for car accidents, identifying negligent actions is not an easy task. In cases where debris in the road caused an accident, there are many aspects that must be investigated prior to determining if there was negligence. If debris was found to be from an individual that improperly anchored items to a vehicle before travel, the fault could lie with them. Likewise, it is the responsibility of the highway department to keep roads and highways free of debris and clear of hazards. If they are not, it could suggest negligence on their part.
